Acceptance of inheritance is the legal act by which a person, known as the heir, expresses their wish to receive and acquire the assets, rights and obligations due to them following the death of the deceased. This act may be express or implied, and when it is carried out before a notary it acquires a public formality that guarantees legal certainty.

It is an essential step for the heir to be able to deal with the inheritance legally and to meet the obligations it entails, such as paying debts or taxes.

What is acceptance of inheritance for?

  • To legally transfer the deceased's assets and rights to the heir
  • To take on the obligations and debts relating to the estate
  • To allow the inherited assets to be registered and managed
  • To protect the heir in the case of acceptance with benefit of inventory

What does the notary do in an acceptance of inheritance?

  1. Informs the heir of the legal consequences of accepting (unconditionally or with benefit of inventory)
  2. Records the heir's express wish to accept the inheritance
  3. Drafts the public deed (escritura pública) of acceptance of inheritance
  4. Authorises and signs the document to give it public validity
  5. Provides copies for subsequent formalities (registry, banks, public authorities)

Types of acceptance of inheritance

  • Unconditional acceptance (pura y simple): the heir acquires the assets and obligations of the estate as they stand, and is liable with their own assets if the debts exceed the value of the estate.
  • Acceptance with benefit of inventory (beneficio de inventario): the heir is liable for the debts only up to the value of the inherited assets, protecting their personal assets.
  • Renunciation of the inheritance: the heir decides not to accept or acquire any right or obligation.
  • Acceptance may be express (declared before a notary or in a document) or implied (through acts that involve dealing with the inheritance)
  • Unconditional acceptance means unlimited liability for the debts
  • Acceptance with benefit of inventory must be formally requested and requires an inventory of assets and debts
  • The time limit for accepting or rejecting the inheritance varies according to local legislation

The public deed of acceptance of inheritance executed before a notary has full legal validity and is backed by the notary's authority to attest, making it easier to manage and transfer the estate securely and clearly for all parties involved.
